To start I am a soldier who loves my job but had a couple down bringings in the army. First I received an article 15 (summerized) for being late to formation on 5 occasions in a course of months. I believe that the punishment was too steep seeing as to how announce the incidents occured and I had contacted people before hand to let them know the situation. Now before this article 15 around april I filed for a divorce and my wife had moved on to somebody else already and knew I had as well and didnt have a problem with that because our marriage was broken. I got my now loved one pregnant and my chain of command has know about the other girl for months. Now they are trying to chapter me for adultery even though the divorce decree has been filed and my spouce has not cared about the whole stuation. Is there a lawyer anyone knows of that can help? is it possible to get chaptered for such a thing?

Ye, they can chapter you out. The best bet is to contact your Legal office (the Defense side of JAG).

It is possible. The Army doesnt recojnize Separation just like it doesnt recognize girlfriend or fiances.

There is no chapter for Adultery. You will first get an Art 15 for adultery. Let get thi straight, your soon to be ex wife ha nothing to do with this. The Army only has 2 martial statuse, married and single. You are still considered married until the judge signs and file the final divorce decree. Face it you screwed up for the 6th time, by your own words.

With this second Art 15, they have now established a pattern of misconduct, which i grounds for a chapter. My guess it will be a 14b chapter. You will either get a general or other than honorable discharge.

It really doesnt matter if your chain of command knew about it for some time. It i your responsibility to know the UCMJ, ie the law, and to obey it. It clearly states in the Manual for Courts-Martial, which the UCMJ can be found, that ignorance of the law i not a defense.

All I can say i ready to be a civilian because your employment with the Army i over.

Lets say, for the sake of argument, that your question is valid and youre not just a troll. The elements for adultery are that a member has to wrongfully have sexual intercourse with a certain person, that at the time of the alleged violation the member or other person was married to someone else, and finally that the conduct was prejudicial to good order and discipline in the armed forces or was of a nature to bring discredit to the armed forces. So, if what you say is true, theres no adultery. Unfortunately for you, under Article 134, the Service can construct a UCMJ charge based on just about anything that it determines is a possible violation of the code.

Here i the deal. You need to get a civilian lawyer that specializes in UCMJ to represent you in this case. That is your only hope. And it i going to be expensive. But it can also mean the difference between getting booted out with an OTH, loss of all benefits and the repercussions for a bad discharge for life. Or staying in the service with a letter of reprimand.

Second. They are trying to chapter you for a "patter of misconduct" which just based on what you wrote they have more than enough cause. Way more than enough.

It i up to you now to decide whether you want to go through the expense of fighting it...or simply bending over and taking what i coming.

Highly recommend you call a civilain lawyer now. Your JAG provided Trial Defense work for the Army. And they will expedite your case in a manner that takes your best interest last.

For adultery to be punishable it has to directly being discredit on the military, talk to JAG

The Army is downsizing by 50,000 people in the next five years.

They are going to begin weeding through what they consider the "undesirables" meaning..soldiers who are getting in a lot of trouble (Article 15 for being late to FIVE formations?) and just not living up to Army standard. Basically, they are getting rid of the people who are not worth the Armys time and money.

You could try to get a lawyer but I doubt if it would help you. If they want you gone, youre going to be gone. The Army has more than enough reasons to get you out.
